Krsto Mijanovic

Overview

Mr. Mijanovic is a Senior Partner and member of the firm’s Executive Committee. He’s also the Co-Chair of the Transportation Law Practice Group and the Chair of the Fire Litigation and Member of the Products Liability Practice Groups. He represents corporations and individuals in tort-based litigation, which includes Fortune 500 companies, national and regional motor carriers, and local businesses.

Transportation

Mr. Mijanovic is the Co-Chair of the Transportation Law Practice Group with a core emphasis on assisting trucking and transportation clients with all of their legal needs throughout California. He has extensive experience defending trucking companies and their drivers in significant transportation matters, multi-vehicle accidents, including tractor-trailers, farm equipment, forklifts, cranes, aerial work platforms, and man lifts. He is also a member of the firm’s rapid-response team for transportation accidents. The Immediate Response Team is comprised of legal counsel, expert consultants, field adjusters and investigators, who are available twenty-four hours a day to respond to any transportation emergency to interview the driver, control the site, begin reconstruction, secure the evidence and, if requested, deal with the media.

Fire Litigation

Mr. Mijanovic specializes in defending wrongful death and personal injury cases resulting from fires in residential and commercial buildings, including wildfire litigation. He has examined hundreds of fire scenes and has extensive experience as lead trial counsel on hundreds of fire cases where he has represented utilities, manufacturers, premises owners, and contractors. His depth of knowledge and expertise in these fields gives him a unique perspective in litigation and trial, enabling him to achieve the best results for his clients in a cost-effective manner. His wealth of experience allows him to provide valuable advice to clients and experts at the critical stages of a case, including: retention of experts; failure analysis; defending or examining fire experts; analyzing and advocating evidentiary issues such as admissibility of fire experts’ testimony under Daubert or Frye challenges; and preventing or advocating for spoliation sanctions for the destruction of evidence.

Products Liability

Mr. Mijanovic has defended numerous product manufacturers in hundreds of wrongful death, catastrophic personal injury, and subrogation matters, in state and federal court, in diverse industries, including agriculture, aviation, construction, HVAC systems, medical, and motorsports and recreation.

Business Solutions

Mr. Mijanovic’s practice focuses on various real estate and commercial disputes. He has extensive experience as lead trial counsel on various business contract disputes, lender liability, title insurance claims, fraud, foreclosure actions, enforcement and defense of mechanics liens and stop notices, commercial and residential evictions, and a variety of collection matters. He has extensive experience representing lender institutions, commercial banks, and investment banks in litigation filed in all State and Federal courts throughout California. Mr. Mijanovic’s experience also extends to actions under multiple statutes including the Fair Credit Reporting Act, the Truth in Lending Act, the Fair Debt Collection Practices Act, the Real Estate Settlement Procedures Act, and the Home Ownership and Equity Protection Act.

Legal Malpractice

Mr. Mijanovic has experience as lead trial counsel defending professional negligence and breach of fiduciary duty claims involving transactional and corporate law, which includes a recent jury defense verdict in a legal malpractice case alleging in excess of $3 million in damages.
