The nature of the trucking industry lends itself to a unique blend of employee drivers, owner-operators, and/or independent contractors who all work to move goods in interstate commerce. In order to ensure that both drivers and their motor carriers are covered in the event of injury which occurs “on the job,” it is essential to have a basic understanding of the duties and other potential legal issues facing all parties in such cases. This presentation discusses the interplay of occupational accident insurance, workers’ compensation, and the statutory employee, in the event a driver is injured in the course and scope of his or her relationship with the motor carrier.
