Decedent (68), a married female, presented to the Emergency Room with complaints of jaw pain which may be indicative of a heart condition. She was evaluated by an Emergency Room Physician who diagnosed her with an oral infection. Decedent was brought back to the hospital nine days later in full STEMI (ST Elevation Myocardial Infarction). She was resuscitated three times before DNR status was changed and she expired. Ms. Haskins filed a Motion for Summary Judgment and plaintiff dismissed the claim on the eve of the date that the opposition to the motion was due.
