Plaintiff, a 77 year old woman, underwent surgery for placement of a bladder sling to treat urinary incontinence. Following the procedure, upon returning from the bathroom, with assistance by a nurse, plaintiff slipped and fell while attempting to return to the gurney in the recovery room. Plaintiff underwent an additional procedure for replacement of a failed sling a few days later and subsequently underwent two microdiscectomies in the subsequent year. The matter was resolved informally among counsel shortly after the deposition of the plaintiff and the acquisition of the Medicare lien.
