Plaintiff, a 68 year old woman with myriad health issues, claimed both General Negligence and Medical Malpractice. Plaintiff underwent a repair of an abdominal aortic aneurysm after which she was diagnosed an intraperitoneal abscess and retained foreign object (lap sponge). The foreign object was removed via a subsequent surgery. Ms. Haskins was able to negotiate the dismissal of the General Negligence cause of action as well as that of a resident who was involved in the subject surgery early on in the litigation. After identifying and working with plaintiff’s counsel to substantially reduce a Medi-Cal lien, the matter was informally negotiated amongst counsel and resolved on behalf of the hospital defendant. The matter continued as to the physician defendants.
