Plaintiff, a 66 year old woman, was scheduled for a bariatric procedure (gastric bypass) at defendant’s hospital. Plaintiff claimed that multiple failed attempts to intubate prior to surgery resulted in the surgery being aborted and an injury to her aerodigestive tract requiring a tracheostomy. Ms. Haskins negotiated a dismissal of hospital for waiver and secured an Order Re Good Faith on the dismissal.
