In 2018, plaintiff, a then 39 year old healthcare professional, requested defendant dentist to perform substantial restoration of eight upper teeth which required the extraction of two unsalvageable teeth. Plaintiff claimed trigeminal neuralgia from one extraction and abandoned care. Following consultation and various treatments with nine other dentists, plaintiff ultimately had completion of the restoration nearly three years later. Plaintiff’s claim was filed in 2019, an unsuccessful mediation was conducted in 2020 and a second mediation was held in 2021, shortly before expert discovery commenced, at which time a resolution was possible.
