Program Description
A judicial finding that a party is a “prevailing party” results in the shifting of the financial burdens of litigation from one party to another. This presentation looks to the applicable sources of law that govern who is a prevailing party, judicial decisions governing the awardability of fees and costs, and addresses some practical legal strategies for asserting these rights and defending against such claims.
SDDL is an organization of lawyers engaged in the defense of civil litigants. The objectives of this organization are: to provide a forum for mutual education through the exchange of ideas with counsel in San Diego County; to promote cordial relations among its members; to promote improved public perception of its members through service to the community; and to maintain the standards of professional conduct.
