Whether perpetrated by a former or current employee, customer or scorned spouse, no company is immune from workplace violence. In this breakout session, the panel will explore how and why some companies seem to do a better job of preventing, managing and navigating the various potential employment law claims that can arise based on decisions made before, during or after such a crisis. Claims run the gambit-including OSHA violations, negligent retention, negligent hiring and negligent supervision, defamation and assault and battery. How are risks screened out during the hiring process when labor shortages are so severe? Were there red flags that were unreasonably minimized or worse yet…ignored? What about social media posts or anonymous concerns expressed by coworkers about an employee? How should the company react without overreacting? What proactive steps can and should be taken before, during and after a high-risk termination?
